Terms & Conditions
1. About Cookzie and Scope of These Terms
These Terms and Conditions (“Terms”) govern access to and use of the Cookzie website, mobile website and any related online service through which Cookzie offers products or services (collectively, the “Website”).
The Website operates under the brand name Cookzie (“Cookzie”, “Company”, “we”, “us” or “our”).
These Terms apply to every visitor, registered user and purchaser (“User”, “you” or “your”). They operate together with our Privacy Policy, Shipping and Delivery Policy, Cancellation/Return/Refund Policy, Warranty Policy and any product-specific terms displayed on the Website.
If a product-specific term conflicts with these Terms, the product-specific term will apply only to that Product and only to the extent of the conflict, subject always to applicable law.
Nothing in these Terms excludes, limits or overrides any right or remedy that cannot lawfully be excluded or limited under the Consumer Protection Act, 2019, the Consumer Protection (E-Commerce) Rules, 2020 (as amended), or any other applicable law. Pasted markdown
2. Definitions
For the purpose of these Terms:
Business Day means a day other than Sunday or a public holiday at the relevant place in India.
Order means your offer to purchase one or more Products through the Website.
Product means any appliance, accessory, spare part, service or other item displayed or sold through the Website.
Order Confirmation means our written or electronic acceptance of an Order after verification, subject to these Terms.
Force Majeure Event means an event beyond reasonable control, including natural disasters, epidemics, war, civil disturbance, government action, transport disruption, labour disruption, power or telecommunications failure, certain cyber incidents, or failure of an essential supplier or logistics provider. Pasted markdown
3. Eligibility and Authority
You must be legally competent to contract under the Indian Contract Act, 1872 to place an Order.
A person below 18 years of age may use the Website only through and under the supervision of a parent or legal guardian who agrees to these Terms and is responsible for the transaction.
If you use the Website for a business or organisation, you confirm that you are authorised to bind that business or organisation.
4. Account Registration and Security
When creating or using an account on the Website:
- You must provide accurate, complete and current information and promptly update it when it changes.
- You are responsible for safeguarding your password, one-time passwords and account access, and for activity conducted through your account, except where caused by our breach of applicable law or security obligations.
- You must promptly notify us of any suspected unauthorised use of your account.
- We may require reasonable identity or transaction verification before acting on sensitive requests.
- We may reject duplicate, false, automated or fraudulent registrations and may suspend access while we investigate suspected misuse. Pasted markdown
5. Product Information and Availability
We take reasonable care to display Product descriptions, specifications, dimensions, capacity, colour and images accurately.
Screen settings, lighting, manufacturing updates and batch variations may cause minor differences that do not materially affect product performance.
Props, food, utensils and accessories shown in lifestyle images are not included unless expressly stated.
Product availability is subject to stock and successful verification. Adding a Product to a cart or wish list does not reserve the Product.
We may correct an obvious content error, withdraw a Product, impose reasonable quantity limits, or decline an Order before acceptance.
If an accepted Order cannot be fulfilled, we will notify you and refund any amount paid for the unavailable item within a reasonable period.
Mandatory product and seller information, including MRP, applicable taxes, quantity, manufacturer/packer/importer details, country of origin where required, warranty information and customer-care details, will be displayed as required by applicable law.
Customers should review the product page, packaging, user manual and safety instructions before using a Product. Pasted markdown
6. Prices, Offers and Taxes
- Prices are stated in Indian Rupees and are inclusive or exclusive of taxes only as clearly disclosed at checkout.
- Delivery, installation, convenience or other lawful charges, if any, will be shown before payment.
- The price payable is the price confirmed at checkout, subject to correction of a clear and genuine pricing or typographical error before dispatch.
- Coupons, bundles, gifts and promotional offers are subject to their stated period, eligibility, stock and usage limits.
- Promotional offers cannot be exchanged for cash unless required by law.
- If a price or Product-information error is discovered, we may contact you for confirmation at the corrected price or cancel the affected item and issue a full refund.
- We will not charge you a higher amount without your express approval.
- Where a price reduction is advertised, we will display pricing information in accordance with applicable law, including any legally required reference or prior price. Pasted markdown
7. Orders and Contract Formation
An Order placed by you is an offer to purchase.
An automated acknowledgement only confirms receipt of your Order and does not constitute acceptance.
A binding sale contract is formed when we issue an Order Confirmation after payment and verification, or when the Product is dispatched, whichever occurs first.
Separate Products in one Order may be accepted and dispatched separately.
We may, acting reasonably, refuse or cancel an Order before dispatch for reasons including stock unavailability, payment failure, suspected fraud or resale abuse, delivery restrictions, an obvious error, a legal or regulatory requirement, or inability to verify essential Order information.
If payment has been collected for a cancelled item, we will refund the amount paid without imposing a cancellation charge on you. Pasted markdown
8. Payments
Payments must be made in Indian Rupees through the payment methods displayed at checkout.
The availability of a payment method may depend on location, Order value, risk checks or service-provider availability.
You confirm that you are authorised to use the selected payment instrument and that the information provided is correct.
Payment processing may be performed by regulated banks, payment gateways or other third-party providers under their own terms.
We do not control a bank’s authorisation, limits, downtime, decline decision or settlement delay. However, this does not affect obligations that applicable law places directly on Cookzie.
We do not ordinarily store complete card credentials. You must never share your card PIN, CVV or OTP with anyone claiming to represent Cookzie.
If an amount is debited but the Order is not confirmed, reversal timelines may depend on the bank or payment provider. We will provide reasonable assistance using available transaction records.
We may use lawful anti-fraud checks, request additional verification, withhold dispatch while verification is pending, or cancel and refund a transaction that appears unauthorised, unlawful or abusive. Pasted markdown
9. Shipping, Delivery and Risk
Delivery estimates are indicative unless expressly guaranteed.
Delivery times may change because of address accuracy, serviceability, weather, public restrictions, carrier delays or a Force Majeure Event.
We will provide tracking information when available.
You must provide a complete, accurate and serviceable address and be available to receive the shipment.
Additional delivery attempts or return-to-origin costs caused by an incorrect address, refusal without valid reason or repeated unavailability may be charged or deducted only if clearly disclosed and permitted by law.
Title and risk of accidental loss or damage pass to you when the Product is delivered to you or to a person authorised by you at the delivery address.
This does not limit your rights regarding a missing, damaged, defective, counterfeit or incorrect Product.
Please document any visible transit damage and contact Customer Care promptly so that we can investigate the matter with the carrier. Pasted markdown
10. Cancellation by You
You may request cancellation through the available Website option or Customer Care.
If the Product has not been dispatched, we will ordinarily cancel the Order and initiate a full refund.
If the Product has already been dispatched, cancellation may be processed as a refusal or return. Reasonable forward or reverse logistics charges may be deducted only where permitted by law and clearly disclosed before the purchase or cancellation.
No such deduction will apply where the cancellation or return is due to our error, a wrong Product, verified transit damage, a manufacturing defect, or another ground for which the law requires us to bear the cost.
We will not impose a cancellation charge on a consumer unless a similar charge is also borne by us when we unilaterally cancel an accepted Order for a comparable reason, as required by applicable law. Pasted markdown
11. Replacements Policy
Eligibility, request windows, exclusions and the return process are set out in the Replacement Policy displayed on the Website and the applicable product page at the time of purchase.
That policy forms part of these Terms. Nothing in the policy restricts a mandatory statutory remedy.
Customers may be required to provide reasonable proof of purchase and, where relevant, photographs, videos, serial numbers, packaging information or a description of the issue so that the request can be assessed.
Returned Products may be inspected for identity, completeness, condition, damage, installation, misuse, alteration, missing parts and serial-number mismatch.
A discretionary change-of-mind return may be declined for a used, installed, damaged, incomplete, personalised, hygiene-sensitive or tampered Product where the applicable policy clearly excludes it and the law permits such exclusion.
A verified wrong, damaged, defective or materially misdescribed Product will be handled through repair, replacement or another remedy as required by the applicable policy and law.
For an accepted Replacement, we will initiate payment to the original payment method within the period stated in the applicable policy and within any reasonable period required by law.
Bank or payment-provider posting times are outside our direct control.
Cash-on-delivery Replacement may be made to a verified Indian bank account or UPI ID supplied by the purchaser. We may require identity and account verification to prevent fraud and misdirected payments.
Original delivery or Replacement charges are non-refundable only where this was clearly disclosed, the Replacement is not caused by our breach and applicable law permits the deduction. Pasted markdown
12. Warranty, Installation and After-Sales Service
Any warranty is limited to the period, Product, territory, parts and conditions stated on the product page, warranty card, invoice or user manual.
Where these documents conflict, the term more favourable to the consumer will apply unless the difference is an obvious error or applicable law requires otherwise.
Unless covered by law or an express written warranty, warranty service may exclude damage caused by misuse, accident, liquid ingress where the Product is not designed for it, improper voltage, unauthorised repair, commercial use of a domestic Product, failure to follow safety instructions, normal wear and tear, consumables, cosmetic damage that does not affect functionality, pests, external wiring or events beyond the Product’s reasonable operating conditions.
Do not open, repair or modify electrical Products except through an authorised technician.
Warranty service may require troubleshooting, proof of purchase, serial-number verification, safe packaging, inspection, repair or replacement with an equivalent unit.
Replaced parts may be retained by Cookzie where permitted by law.
Statutory consumer rights remain unaffected. Pasted markdown
13. Safe and Lawful Use
Customers must:
- Use every Product only for its intended purpose and in accordance with its rating label, user manual, safety warnings and applicable electrical standards.
- Keep packaging, cords, blades, hot surfaces and electrical Products away from children except under responsible adult supervision.
- Stop using a Product that is damaged, emits smoke or a burning odour, causes sparking, has an exposed wire or otherwise appears unsafe.
- Disconnect the power where it is safe to do so and contact Customer Care when a Product appears unsafe.
- Ensure appropriate installation conditions, socket compatibility, earthing, supply voltage and water or gas connections unless installation is expressly included with the sale. Pasted markdown
14. User Conduct and Prohibited Activities
You must not use the Website to:
- Break any law.
- Impersonate another person.
- Submit false information.
- Interfere with the security or operation of the Website.
- Introduce malware.
- Scrape, crawl or extract Website content through automated means without permission.
- Reverse engineer any restricted technology.
- Evade purchase limits.
- Commit payment, return, coupon, review or warranty fraud.
- Harass any person.
- Infringe intellectual-property, privacy or other rights.
We may preserve records, restrict functionality, cancel affected transactions, suspend or terminate access, and report suspected unlawful conduct to competent authorities where reasonably necessary and lawful.
A suspended User must not create another account to evade a restriction.
We may reinstate access following an appropriate review. Pasted markdown
15. Reviews and User Content
If you submit a review, image, video, question or other content, you confirm that it is genuine, lawful, relevant, non-confidential and does not infringe another person’s rights.
You retain ownership of your content but grant Cookzie a non-exclusive, worldwide, royalty-free, transferable and sublicensable licence to host, reproduce, adapt for formatting, translate, publish and display that content for operating, promoting and improving Cookzie, subject to applicable privacy law.
We may moderate or remove content that is unlawful, deceptive, abusive, irrelevant, contains personal data, violates these Terms, or is connected with manipulation or an undisclosed incentive.
We will not suppress a genuine negative review merely because it is unfavourable. Pasted markdown
16. Intellectual Property
The Website and its content, including the COOKZIE name and marks, logos, packaging, product photography, graphics, text, videos, catalogues, software, layout and trade dress, are owned by or licensed to Cookzie and are protected by applicable intellectual-property laws.
No right or licence is granted except the limited, revocable right to access the Website for personal, lawful and non-commercial use.
Without prior written permission, you must not reproduce, modify, republish, distribute, sell, license, frame, mirror, create derivative works from, remove rights notices from or commercially exploit Website content.
Resellers may use approved brand assets only under separate written authorisation and applicable brand guidelines. Pasted markdown
17. Copyright and Intellectual-Property Complaints
A rights owner who believes that content on the Website infringes intellectual property should send a written notice to the contact listed in Section 27.
The notice should include:
- The right being claimed.
- Details of the protected work or mark.
- The allegedly infringing content and its exact URL.
- Contact details.
- A good-faith statement.
- Proof of authority.
We may request further information and take appropriate action consistent with applicable law. Pasted markdown
18. Third-Party Services and Links
The Website may contain links to marketplaces, social networks, payment providers, logistics providers or other third-party services.
The availability, content, security and practices of these third-party services are controlled by the respective providers.
Your use of a third-party service is governed by its own terms and policies.
Cookzie is not responsible for an independent third party’s acts or omissions, except to the extent liability cannot be excluded by law or the third party acts on our behalf in a manner for which we are legally responsible. Pasted markdown
19. Privacy and Electronic Communications
Our collection and use of personal data are governed by our Privacy Policy and applicable data-protection law.
By providing your contact details, you consent to receive transactional messages necessary to service your account, Order, delivery, payment, warranty or complaint.
Marketing communications will be sent only on a lawful basis and may be opted out of through the method provided.
Service and legal notices may still be sent where necessary. Pasted markdown
20. Website Availability and Disclaimers
We aim to keep the Website secure and available but do not promise uninterrupted, error-free or virus-free access.
We may maintain, update, restrict or discontinue Website functionality.
Product performance depends on correct product selection, installation, operating conditions, maintenance and proper use.
To the maximum extent permitted by law, implied warranties relating solely to Website availability are excluded.
Nothing in these Terms excludes an express Product warranty, liability for a defective Product, deficiency in service, unfair trade practice, fraud, wilful misconduct, gross negligence, personal injury or any other liability or remedy that cannot lawfully be excluded. Pasted markdown
21. Limitation of Liability
To the maximum extent permitted by applicable law, Cookzie will not be liable for indirect, incidental, special or consequential loss, loss of profit, revenue, data, goodwill or business opportunity arising from the use of the Website or a Product where such loss was not reasonably foreseeable or was caused by the User’s misuse, unauthorised modification, failure to follow instructions or an independent third party outside our reasonable control.
For claims that may lawfully be limited, Cookzie’s aggregate liability relating to an affected Order will not exceed the amount paid for the affected Product.
This limitation does not apply to refunds properly due, statutory product liability, personal injury or death caused by negligence, fraud, wilful misconduct, gross negligence or any liability that applicable law prohibits us from limiting. Pasted markdown
22. Indemnity
To the extent permitted by law, you will indemnify and hold harmless Cookzie, its proprietor/partners, affiliates, officers, employees and agents against third-party claims, penalties, losses and reasonable legal costs arising directly from your unlawful use of the Website, infringement of third-party rights, fraudulent conduct, unauthorised commercial exploitation of Cookzie content or material breach of these Terms.
This clause does not require a consumer to indemnify Cookzie for Cookzie’s own breach, negligence, unlawful act or statutory liability. Pasted markdown
23. Suspension and Termination
We may suspend or terminate access, cancel unfulfilled Orders or restrict activity where reasonably necessary to protect Users, the Website or Cookzie; comply with applicable law or an authority’s direction; investigate fraud or security risks; or address a material or repeated breach.
Where practicable and lawful, we will provide notice and an opportunity to clarify.
Termination does not affect accrued payment obligations, accepted refunds, warranty claims, statutory rights or provisions intended to survive termination. Pasted markdown
24. Force Majeure
Neither party will be liable for delay or failure caused by a Force Majeure Event to the extent the affected party could not reasonably prevent or overcome it.
We may extend delivery, arrange an alternative solution, or cancel and refund an unfulfilled affected Order.
Payment obligations for Products already delivered are not excused. Pasted markdown
25. Governing Law and Dispute Resolution
These Terms and transactions through the Website are governed by the laws of India.
The parties should first attempt to resolve disputes in good faith through the grievance process described in Section 27.
Subject to the mandatory jurisdiction and remedies available to consumers under applicable law, courts at Delhi shall have jurisdiction over disputes arising from these Terms.
Nothing in this clause prevents a consumer from approaching a competent Consumer Commission or any other authority having mandatory jurisdiction. Pasted markdown
26. General Provisions
Severability: If any provision is held unlawful or unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will continue.
No Waiver: A delay or failure to enforce a right does not constitute a waiver of that right.
Assignment: You may not assign your rights or obligations without our written consent. We may assign these Terms as part of a genuine reorganisation, transfer of business or change in operator, provided your statutory rights are not reduced.
Entire Agreement: These Terms and the policies incorporated into them constitute the agreement concerning Website use and Orders, except for an express written agreement separately signed by Cookzie.
Language: An Indian-language translation may be provided for convenience. If there is an inconsistency, the English version will govern to the extent permitted by law.
Updates: We may revise these Terms for legal, operational or security reasons. The revised version will be posted with an updated date. Material changes will apply prospectively unless applicable law requires otherwise. Terms applicable to an accepted Order will not be changed retrospectively to your material disadvantage. Pasted markdown
27. Grievance Redressal and Contact Details
For an Order, cancellation, return, refund, warranty, privacy or Website complaint, please contact Cookzie Customer Care or the Grievance Officer.
The Grievance Officer will acknowledge a consumer complaint within 48 hours and seek to redress it within one month, or sooner where applicable law requires.
